TERMS & CONDITIONS
NRI Customer(s) /Prospective Customer(s) - Account Related Requests/Opening Request/s
These terms and conditions (Terms) are applicable to the Customer(s)/User
(defined hereinafter)
who is/are willing to Open/ Maintain A/c’s with Indian Bank.
By accepting these Terms and placing their request through the Bank's website, the individual be the existing Customer(s) or the Prospective Customer(s) (Individual/s using this portal) hereby agrees to be governed by Terms as mentioned herein and amendments made thereto from time to time.
Definitions:
Unless contrary to the context or meaning thereof, the following words and phrases shall be construed in this document, as under:
Bank refers to Indian Bank,
a body corporate constituted under the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970, having its Corporate Office at PB No: 5555, 254-260, Avvai Shanmugam Salai, Royapettah, Chennai-600078.
"Account(s)"/ "Account"
refers to the bank account(s) so maintained or to be maintained by the Customer(s) with Indian Bank and are eligible for purposes of availing the Service in accordance with this Terms. "Customer(s) /Prospective Customer(s) shall mean Non Resident Indian (NRI) maintaining the Account(s) or interested to maintain the accounts with Indian Bank respectively.
“Customer/ User”
refers to an individual who is a Non-resident Indian maintaining/ to be opening an account with Indian Bank using “Online Link”.
"Online Link"
shall mean a link which shall be hosted in the website of Indian Bank with URL
https://apps.indianbank.in/customeronboarding/
for effecting the acceptance of request of the Customer(s) (s), for the “Intended Purposes”.
"Intended Purposes"
shall collectively or individually refer to periodical KYC updation, conversion of
resident account to NRO
, requests for grouping of accounts and updation of e-mail/ mobile number, Submission of request for the opening of Saving Bank Accounts initiated by the Customer(s) through the
“Online Link.”
Customer(s) Authorizations, Confirmations and Declarations:
• The Customer(s) hereby declare and confirm that he shall furnish to the Bank true and accurate information together with supporting documentary evidence for the Intended Request(s). The Customer(s) hereby authorizes the Bank to process his desired request submitted by him through the
“Online Link”
hoisted in the Bank's website.
Accuracy of Information
• The Customer(s) is responsible for the correctness of information provided to the Bank through the use of this application. The Bank accepts no liability for the consequence arising out of erroneous/ incomplete information provided by the User. The user shall keep his information updated with the Bank at all times and shall be liable for any discrepancy that may occur/ noticed at any point of time.
• Customer(s) declares and confirms that the Bank shall be entitled to rely on all/any communication, information and details provided on the
“Online Link”
and all such communications, information and details shall be final and legally binding on the Customer(s) and the Customer(s) agrees to indemnify the Bank for any loss or damage caused to the Bank on account of the Bank placing reliance on such information and documents provided besides this.
• The Customer(s) hereby declares that he has not withheld any material information that may affect assessment/categorization of the Accounts and fully understand and agrees that failure to provide requisite documentation and information shall result in rejection of the request raised/made.
• The Customer(s) agrees to take all necessary precautions to prevent unauthorized and illegal use of the
“Online Link”
and confirms that the Bank shall not be held liable or responsible to the Customer (s) in the event of any such unauthorized and illegal use of facility offered by the Bank.
• The Customer(s) hereby agree and confirm that his failure to disclose any material fact known to him, now or in future, may invalidate his Intended Request and is aware that the Bank reserve the right to put restrictions in the operation of his Account or close it or report to any regulatory authority or to take any other action as may be deemed appropriate.
• The Customer(s) hereby gives its consent to the Bank to deduct the applicable charges/fees as prescribed by the Bank.
• The Customer(s) agrees and understands that the Service Request once submitted cannot be withdrawn by the Customer(s) and that the Bank shall not be liable for any updation made in the Account of the Customer(s) in accordance with the Service Request raised.
• The Customer(s) consents and agrees to the right of the Bank to take necessary action, legal or otherwise, if the Bank finds any wilful withholding of information or misrepresentation by the Customer(s).
Liability of the Customer(s):
The Customer(s) alone shall be liable for any loss from unauthorised transactions in the
“Online Link”
Portal accounts if he has breached the terms or contributed or caused the loss by negligent actions including the following:
➤ Keeping a written or electronic record of
“Online Link”
Portal password.
➤Disclosing or failing to take all reasonable steps to prevent disclosure of the
“Online Link”
Portal password to anyone including any minor, Bank staff and/or failing to advise the Bank of such disclosure within reasonable time.
➤ Not advising the Bank in a reasonable time about unauthorized access to or erroneous transactions in
“Online Link”
Portal accounts.
The Bank shall in no circumstances be held liable by the user if
“Online Link”
portal access is not available in the desired manner for reasons including but not limited to natural calamity, floods, fire and other natural disasters of any kind, legal restraints, faults in the telecommunication network or Internet or network failure, power breakdown or UPS breakdown, software or hardware failure and or error or any other reason beyond the reasonable control of the Bank. The Bank shall in no way be liable for any loss or damage that may occur due to hacking of the account by any persons
other than the user
, which fits in the definitions of a 'Cyber Related Crime' as accepted internationally. The Bank shall under no circumstances be liable for any damages whatsoever whether such damages are direct, indirect, incidental, consequential and irrespective of whether any claim is based on loss of revenue, investment, production, goodwill, profit, interruption of business or any other loss of any character or nature whatsoever and whether sustained by the Customer(s) or any other person, indirect, incidental, consequential and irrespective of whether any claim is based on loss of revenue, investment, production, goodwill, profit, interruption of business or any other loss of any character or nature whatsoever and whether sustained by the Customer(s) or any other person.
The Customer(s) further specifically agrees to indemnify, defend and hold harmless, the Bank and its employees from any losses occurring as a result of the:
1. the Customer(s) sharing his Account credentials with any third party/authorising any third party to use the
“Online Link”
and avail the Service Request.
2. if the Customer(s) having breached the Terms.
3. The Customer(s) providing incorrect or incomplete information.
INDEMNITY
The Customer(s) shall indemnify and hold the Bank harmless against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses whatsoever which the Bank may at any time incur, sustain, suffer or be put to as a consequence of or by reason of arising out of providing
“Online Link”
Portal facility or by reason of the Bank in good faith taking refusing to take or omitting to take action on any instruction given by the Customer(s).
In consideration of Bank providing the
“Online Link”
, the Customer (s) agrees to indemnify, defend and hold harmless, the Bank and its employees against all losses, damages, expenses, actions, claims, demands and proceedings whatsoever, that Bank may incur, sustain, suffer or be put to at any time as a consequence of acting on the Request of the Customer(s).
Consent from the Customer/ Prospective customer
The Customer hereby consents for processing of his personal information including location details for the purpose of maintaining and continuing account based relationship with the Bank. The customer further authorises the Bank to send messages/ emails/ calls regarding the account including new offerings made by the Bank to such category of customers. For this purpose, the Bank may share the personal information to its vendors/ affiliates/ subsidiaries etc.
Unless the context requires otherwise, in this document; reference to one gender includes a reference to the other, words importing the singular include the plural and vice versa.
Mailing Address:
All correspondence/delivery of any instructions by the Bank or their communication shall only be made at the normal postal address and/or e-mail address and / or mobile number as registered with the Bank. The Bank shall in no way be held responsible for non-receipt of the same and Bank can use either or all of the aforesaid mode of communication with the applicant or the user of this
“Online Link”
Disclosure of Personal Information:
The User agrees that the Bank may hold and process his Personal Information on computer or otherwise in connection with
“Online Link”
Portal services as well as for statistical analysis and credit scoring. The Customer(s) also agrees that the Bank may disclose, in strict confidence, to other institutions, such Personal Information as may be reasonably necessary for reasons inclusive of, but not limited to, the following:
• Participation in any telecommunication or electronic clearing network.
• Compliance with a legal directive.
• Credit rating by recognized credit rating/ scoring agencies.
• Fraud prevention purposes.
Notices:
The Bank and the User may give notices under these Terms and Conditions:
• Electronically to the mailbox of either party. Such notices will be regarded as being in writing.
• In writing by delivering them by hand or by sending them by post to the last address given by the User
In addition, the Bank may also publish notices of general nature, which are applicable to all Users of
“Online Link”
Portal on its web site. Such notices will have the same effect as a notice served individually to each User and or that of a notice published in a newspaper of print media.
Changes of Terms & Conditions:
The bank has the absolute discretion to amend or supplement any of the Terms at any time without prior notice to each user about the same. The changes so made will be available on the website of the bank which the Customer(s) are requested to refer to from time to time. Proposed and existing users to the services are advised to confirm themselves about the terms and conditions contained therein to take note of any changes, modifications and/or amendments which may be made to scheme from time to time by the Bank. The
bank
may introduce new services within
“Online Link”
Portal from time to time. The existence and availability of the new functions will be displayed on the bank's website along with the revised/changed terms and conditions applicable to such other
“Online Link”
Portal services. By using the services, it is deemed that the User agrees to be bound by the terms and conditions applicable.
The Bank reserves the right to make any changes, alterations, cancellations, in the above Terms by hosting them on its website. The Customer(s) shall be responsible for reviewing these Terms regularly including the amendments as posted on the website.
Other important terms and conditions:
• The Customer(s) confirms to have read, understood and will be bound to abide by the Terms herein.
• The Customer(s) needs to intimate Bank in writing or through other Authorised Channels about of any change in the contact details/address. Customer(s) needs to submit documentary proof wherever applicable.
Governing Law:
The terms and conditions and/or the operations in the accounts of the Customer(s) maintained or to be maintained by the Bank and/or the use of the services provided through
“Online Link”
shall be governed by the appropriate laws as prevalent in India and no other nation. The User and the Bank agree to submit to the exclusive jurisdiction of the Courts located in Chennai, India as regards any claims or matter arising under these terms and conditions.
For redressal of grievances, the Customer(s) may utilize the Grievance Redressal mechanism; details of which are available on the Bank’s website

The Bank accepts no liability whatsoever, direct or indirect, for non-compliance or breach of the laws of any country other than the Republic of India. The mere fact that the
“Online Link”
Portal can be accessed through Internet by a User in a country other than India shall not be interpreted to imply that the laws of the said country shall govern these terms and conditions and/or the operations in the
“Online Link”
Portal accounts of the Customer(s).
The use of the
“Online Link”
Portal facility by a person from any place other than India will not alter the situation and the said user shall be deemed to have submitted himself to the laws of the Republic of India and only the Indian courts shall have the jurisdiction.
• These Terms supplement and are in addition to the terms and conditions applicable to the operation of the Account(s).
• The Bank reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Online Link.
